eSmartech LLC is the sole developer, operator, and legal entity responsible for the DinePals app, website, admin portal, and partner portal. 2. Nature of the Service
DinePals is a social dining discovery and communication platform. It is not a dating service, employment service, matchmaking guarantee, event insurer, restaurant reservation system of record, or food delivery service. DinePals:
- Does not guarantee the identity, intentions, background, or conduct of any user, host, or restaurant partner;
- Does not perform criminal background checks or identity verification on users unless expressly stated in the App;
- Does not organize, staff, supervise, or insure meals or events listed or arranged through the Service;
- Is not a party to any transaction between users and restaurants or hosts.
3. Consumer Safety Notice — In-Person Meetings
Because DinePals connects users for real-world dining experiences, we ask all users to prioritize personal safety:
- Choose public, well-lit venues, particularly for first-time meetings.
- Share your plans (who, where, when) with a trusted friend or family member.
- Never share financial information, passwords, or government ID with another user.
- Trust your judgment — leave any situation that feels unsafe.
- Use the in-App reporting and blocking tools to flag inappropriate behavior immediately.
- Contact local law enforcement in any emergency; DinePals is not a substitute for emergency services.
DinePals disclaims liability for any injury, loss, dispute, or damage arising from an in-person interaction, meal, or event, to the fullest extent permitted by law, as further described in our Terms of Use.
4. Restaurant & Partner Listings Disclaimer
Restaurant events, offers, menus, and availability displayed in the App (including through the partner portal) are provided by third-party restaurants and hosts and may change without notice. DinePals makes reasonable efforts to display accurate information but does not guarantee the accuracy, availability, pricing, or quality of any listed event, offer, or menu item. Consumers should confirm details directly with the restaurant or host before attending.
5. Consumer Complaints & Dispute Process
If you have a complaint about the DinePals Service, we encourage you to first contact us directly (see Section 8) so we can attempt to resolve the issue. If you are a consumer and believe your complaint has not been adequately addressed, you may also contact:
- North Dakota Attorney General's Office — Consumer Protection Division, for consumer protection concerns involving a North Dakota-registered business; or
- The consumer protection agency or attorney general's office in your own state or country of residence.
Formal dispute resolution procedures, including arbitration, are set out in the Terms of Use.
6. Intellectual Property / Copyright (DMCA) Notice
DinePals respects the intellectual property rights of others. If you believe content on the Service infringes your copyright, you may submit a notice to our designated agent containing: (a) your signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and its location; (d) your contact information; (e) a good-faith statement that the use is unauthorized; and (f) a statement, under penalty of perjury, that the notice is accurate and you are authorized to act. Send notices to the contact information in Section 8, marked “Copyright Notice.”
7. App Store Compliance
DinePals is distributed through the Apple App Store and Google Play Store and complies with applicable platform guidelines, including those relating to user safety, data handling, and in-app purchases. Billing for premium features is subject to the terms of the applicable app store. These Terms are between you and eSmartech LLC, not Apple Inc. or Google LLC; however, Apple and Google are third-party beneficiaries of the Terms of Use and may enforce them.
